Dear Walter,

It’s funny how things change

As a kid, I lived in an almost constant dread of report cards. I was a weak student and the gap between my scholastic performance and my folks’ expectations of me was wide and bridged by punishments that -what they lacked in creativity- they more than made up for in longevity.

As an adult, I love report cards. It’s helpful to get an independent assessment of what your strengths and weaknesses are. If you have some thoughts about where this chapter is headed, and what changes you’d like to see, I want to hear from you. The Board of Director’s meetings are open and every member and candidate is invited to attend. In addition, you can write or call me anytime with questions, concerns, suggestions, or just to say hello.

Here’s what I think:

This year couldn’t be getting off to a better start. Though attendance was down at InspectionWorld, the New England Chapter was well represented. Our own Lisa Alajajian was re-elected as a CoR Group Leader, and her territory was expanded to include the Northeastern US and ALL of Canada. Lisa’s networking at the National level has most recently resulted in ASHI NE literature being included in the upcoming JLC Live! presentation in Providence, RI. Way to go, Lis!

Continuing on last year’s trajectory, attendance at our January meeting (featuring 3 MRC’s) was also up. We are about one year into a slow real estate sales cycle, that all of us are feeling financially. Still, our seminars and workshops attendance continue to rise!

I appointed, and the Board of Directors unanimously and enthusiastically approved Chuck Mangio, of Jigsaw Home Inspections in Middleborough, MA as our new Legislative Committee Chairman. Several other members volunteered to serve on committees as well, propelling us along the way to begin implementation of the Chapter’s Strategic Plan. This is very exciting!

Also, members are asked to please keep member and lecturer Sherman Price in mind as he has been ill. Most of you know that Sherm is an ASHI veteran who has given much of his time and expertise to the New England Chapter after moving to the area almost a year ago. Get well soon, Sherm!

Also, if you haven’t been receiving the JLC lately, your membership in our chapter has lapsed. Several members were recently surprised to learn they had not paid their dues and their membership had lapsed. Don’t miss out on all the benefits of membership in ASHI NE. Make sure your dues are up to date

Lastly, I encourage each of you to spend some time looking around www.ashi.org and www.ashinewengland.org A lot of money and effort went into those sites and there is a lot of great information and functionality on both sites, and I don’t think enough members take advantage of it all. You paid for it, you should make use of it.

As always, the Board of Directors is working hard to make sure the coming year is a financial and educational success. If there’s ever something we can do for you, we hope you’ll let us know.

The ASHI-NE Chapter Education Committee is hosting its first 2007 full day continuing education seminar, evening Chapter meeting and education session on Thursday, February 22nd. Mark your calendar now and join us for some exceptional opportunities and receive 6 CEU’s for the day seminar and 3 CEU’s for the evening seminar.

The day seminar should be fun and educational. In the morning session, Bob Mulloy will repeat his presentation “Decks are Dangerous” as presented at the ASHI 2006 Conference in Anaheim, CA. According to Bob, decks have become commonplace in residential homes and are recognized as a desired place for social gatherings. Unfortunately, the number of deck collapses is increasing as more and more substandard decks are built. This session will propose that every deck be considered unsafe, until the home inspector proves otherwise. Bob will follow the deck construction process and will use numerous photographs to describe construction defects and samples of boiler-plated text for risk management. Just as heating system technology has evolved requiring home inspectors to acquire new inspection techniques, safe deck construction has evolved requiring home inspectors to recognize red flags and to recommend safety repairs. After hearing Bob’s presentation, you will never inspect a deck the same way again and will understand why your focus should be on critical connections.

During the afternoon session, OSHA will be present. Mr. Kenneth Mestrella, former “electrical trainer for the NFPA” and now and OSHA representative will be our guest speaker. This presentation will provide an overview of electrical safety in the workplace focusing on the job function and responsibilities of the home inspector. The course will help identify the electrical hazards for the home inspector and the home owner. Subject matter to be covered includes hazard recognition, electrical installation deficiencies, inspection of equipment that may be energized, personal protective equipment that may be required, and voltage testing

The evening Chapter meeting and education session will offer another 3 CEU’s with a 2-hour education session and 1-hour round table. Our guest speaker is Ron Fallon, Vice President of Envirotech Clean Air, Inc. Mr. Fallon is a certified Air System Cleaning Specialist (NADCA), a certified Ventilation System Inspector (NADCA), a certified Applied Structural Dryer (IICRC), a certified Mold Remediation Specialist (AIAQC), a Certified Restorer (NIDR), and a certified HAZWOPER Worker. In an effort to maintain a consistent presence at the State House and, at the same time, reduce the financial burden that out Members have been carrying in order to keep an active lobbyist for our profession on Beacon Hill, the Board has been working to establish a statewide Home Inspectors Political Action Committee. It is only fair that all Home Inspectors in the State, not just ASHI Members, contribute to efforts that benefit all the Massachusetts Home Inspectors. This sort of committee has been very effective for other professional organizations. It’s now time for all Home Inspectors, regardless of professional affiliation, to speak with a larger voice!

We now have a tax identification number and a bank account for the PAC, and we’re looking into establishing by-laws for this organization. We have recently ended our contract with our lobbyist, Anne Lynch Associates, and Anne has generously donated the time and expertise of herself and her staff to help set up the PAC as well as help with our fund raising efforts. This will be a great help in getting the PAC up and running, and we would like to thank Anne for her offer to help.

In the next two weeks, Board Members will begin a campaign to telephone all non-ASHI Home Inspectors in the State to begin funding the PAC. Recognizing that ASHI Members have borne the cost of lobbying efforts until now, we have decided to approach non-ASHI Home Inspectors first. We anticipate requesting an annual contribution of $95.00 This is less than the amount ASHI Members have been contributing this past year through their dues. By spreading the load, we can put our Members’ dues back to work for Chapter initiatives. In order to have the contributions this low, however, we will need a very broad based support. As Home Inspectors represent a relatively small group in a sea of larger players, the Board unanimously feels that it is vital that we have an on-going presence at the State House to look out for the interests of our profession and to educate legislators about what we do and what our needs are.

It’s important that we make the PAC work. Over the next few months, talk the PAC up to any Home Inspector you know or meet. If we all pay a little, we can accomplish a lot for all of us!

As you all must know by now, a bill was submitted to the NH legislature regarding the licensing of home inspectors in New Hampshire. This bill was submitted by the NH Chapter of NACHI. (For the purposes of this email, and until it gets assigned a house bill number, we will refer to this bill as the NACHI bill.)

What you may not know, is that a second bill has been submitted this month to the NH legislature that is very different than the NACHI bill. This second bill was created by the newly formed, non- profit, independent organization called the New Hampshire Coalition for Licensing of Home Inspectors (NHCLHI) as an alternative to the NACHI bill.

Since there is quite a bit of misinformation out there regarding the Coalition, we wanted to clarify the facts on its creation and its goals.

Back in November, a small group of inspectors (including two NACHI inspectors) got together to discuss their opinions of the NACHI bill. (A draft of this bill was posted on the NACHI website.) http://www.nachi.org/nachinhbill2006.htm These inspectors came to a consensus that the NACHI bill neither protected the public nor the home inspector for the following reasons.
** It allowed multiple exams, some of which are Code Compliance exams and on-line, open book exams.
** Its grandfathering standards were too low (ie. If you perform 12 inspections and have passed an on-line, non- proctored test, you are grandfathered)
** It discriminated against out of state inspectors who work in NH (non-residents would have to apprentice, even if they are experienced inspectors)
** It didn't clearly define any standards of practice

These inspectors contacted a legislative consultant for advice on how to proceed. Since there were so many negatives to the NACHI bill, the consultant recommended creating a new bill, and advised using the recently passed Landscape Architect's bill as a template and customizing it to the Home Inspection Profession.

The consultants also recommended starting an independent Coalition of Home Inspectors who would support this new legislation.

Since November, over 300 home inspectors have been contacted via email and word of mouth to join the Coalition and voice their opinions on legislation, and as a result, the Coalition and its new bill evolved as follows:
** 11/06- Email campaign began to inform inspectors to a meeting regarding creating a Coalition.
** 11/27/06- first meeting (open to public) to review Coalition's basic points and gain support.
** 12/06- Email campaign to solicit inspectors to join (46 inspectors joined)
**12/14/06- second meeting (members) to discuss and vote on strategy. A board and president were elected.
** 12/18/06- Bill draft (created by initial inspectors) emailed to members for suggestions prior to next meeting.
** 12/06- Coalition received many suggestions for improving bill and added all received suggestions to the bill for future discussion.
** 1/4/07- 3rd meeting (members) discussed, debated and voted on changes to bill and funding for legislative costs.

Over 60 inspectors (members & non-members) had input into creating this bill, via email and meetings. In fact, the bill changed substantially from the original draft written. These changes were voted on by the members, and as in any group decision, compromises were made, but all-in-all, the Coalition feels this bill is far superior to the NACHI bill.

In January 2007, the Coalition Bill (updated with the voted changes from the 1/4/07 meeting) was submitted to the NH Legislature. The copy you are receiving is currently at the legal department at the statehouse for final edits.

On 1/25/07, after multiple requests, the Coalition finally received a copy of the final NACHI bill that was submitted to the state Legislature. Unfortunately, we were only able to get a hard copy that the NACHI bill sponsor, State Representative Benjamin Baroody faxed to the Coalition's consultants. This faxed bill is VERY different from the earlier version of the NACHI bill. This bill, like ours, has still not been assigned a bill number.

Also, we cannot know at this time what changes may be made to the Coalition bill by the State's legal department or legislators. We wanted to wait for the official, edited bill to come out before distributing it, but since this process may take weeks, we wanted all home inspectors to get a chance to review the Coalition's submitted bill sooner than later.

NOTE: Both bills are subject to change at any time. They are now in the hands of the legislators.

Neither official bill is available online yet, but you can look for them at the General Court website: http://www.gencourt.state.nh.us/ie/ under "Legislation". The Coalition bill will be under the Senate Intro list, the NACHI bill will be under the House Intro list. They should probably both be online and available to the public within a few weeks.

In the mean time, please review the attached comparison chart, based on this NACHI bill received via fax and the Coalition's submitted bill. (Again, this is based on the information we have available at this time.) Since the Coalition's bill has changed since its inception (based on input from home inspectors), we are hoping that more home inspectors will want to join our fight for fair legislation. Membership is open to any home inspector who performs inspections in New Hampshire. (To sign up, please complete the attached Application to Join the Coalition)

Regardless of what happens in the next legislative session, the Coalition will continue to exist, and will need your continued support, to monitor legislative activity of the home inspection profession in New Hampshire. Spread the word. If you know any home inspectors who are not in our email database, but want to be, let us know. Thanks to all the inspectors who emailed, attended meetings, and helped in the creation of this new legislation and the Coalition behind it.

Important Notice & Call to Action to all ASHI members !

We are writing to notify you that the American Society for Testing & Materials (ASTM) will host an organizational meeting to discuss and vote on the development of consensus standards for inspection of Residential Dwellings on February 19, 2007. The meeting will be held at the request of the National Association of Home Inspectors (NAHI) in conjunction with their Annual Conference at the Riviera Hotel in Las Vegas, Nevada.

Your Board of Directors has officially expressed its opposition to this meeting and to the prospect of ASTM moving forward with standards development in home inspection. ASTM has confirmed that the original request to consider development of standards came from NAHI a year ago. In response, ASTM contacted segments of the industry including real estate practitioners, state housing authorities, and government agencies to determine if there was an interest in consensus standards. ASTM indicates that interest was expressed and a meeting took place in September of 2006 where the decision was made to host the February organizational meeting.

Until only a few weeks ago, ASHI was not consulted or invited to participate in these discussions nor were any other home inspector associations other than NAHI. We believe the process ASTM has followed to date has been flawed and influenced by political motives.

ASHI opposes the proposed creation of ASTM inspection standards because we believe they would dilute or replace ASHI's existing industry standards which have been carefully crafted over time, standards which are based on the practical experience of untold numbers of professional home inspections. We believe this would directly undercut our continuous efforts to build the integrity, independence and professionalism of the home inspection profession and would harm our membership which believes that our profession should seek the highest levels of expertise rather than regress to the mean in a likely ASTM homogenization of the competing industry standards. Such a result would also work to the detriment of home buyers and sellers across North America who depend on genuinely proficient professional ASHI inspectors to help them buy and sell homes safely and intelligently.

Our opposition is an effort to not only protect ASHI's Standards and Ethics, it is an effort to protect you. We are sending representatives to the meeting on the 19th to vote against this proposed action, however we need your help in ensuring that ASTM is aware of the opposition. I was asked to install some interior trim work in a house while the owners were on vacation for a week in Texas. The night before they left I received a call and we went over the list of interior trim to be installed and then the owner said "By the way, while you're there could you please look after the cats (3), clean the litter box a couple times and make sure they have food and water?" Of course I said I would (labor charges apply).

All went well during the week as I installed door trim, baseboards and toe kick board under the kitchen cabinets. The cats were well fed and the litter boxes cleaned. The owners returned, and I went back to the house the other day to bring the owner a bill and get paid for the work and also to take measurements for a fireplace mantle they want me to build for them. I received payment for the work and was about to leave and the owner said: "When you come back to install the mantle would you put this piece of toe kick board in place next to the dishwasher?" I looked a little confused because I knew I had installed all the kick boards while they were gone.

Well, when they came home from vacation they saw 2 of the cats sitting on top of an upper wall cabinet in the kitchen with their eyes larger than life and appearing very out of sorts. Then the noise started -- Meow, Meow, Meow. They expected to see the other cat coming from around the corner or down the hall however there was no cat to be seen. They began looking all over for the cat while following the "Meowing" noises. straight into the kitchen. They checked all of the cabinets and closets in the kitchen area to no avail and then they saw a small white paw reaching out from under the cabinet to the left of the dishwasher -- Oh no!!! I had sealed the cat in under the cabinet when installing the toe kick a week earlier. The owner had to take off the toe kick to release the cat. Once released the other cats came down off the cabinet and returned to a normal state of mind. All cats are doing well and the owners still want me to build the mantle. These days, Bob keeps pretty busy remodeling houses in his hometown of Graft on, MA. The ASHI NE Chapter maintains a library of educational books, video tapes and CD’s for Chapter members and candidates to utilize for personal and business growth. Those who wish to sign materials out may do so for a fee of $16 per item ($10 per tape) which covers two-way shipping and handling. Library materials may be used for a two week period, beginning on the date of shipment. Those who fail to return library materials on time will be assessed a fine of $1 / day. If the materials are not received back within two months of date of shipping, you will be charged the cost of replacement. To sign materials out, there is a form that is posted on our web site that is to be completed and sent to the executive office. It is always recommended that you call the executive office to check on the availability of an item. Once this form is received, the executive office will ship the items out with a postage paid return envelope. Walter Perry, executive director of the ASHI NE Chapter has announced that the executive office of ASHI NE will be moving by the end of February. As of March 1st the new office will be located at 53 Regional Drive in Concord. The building is also known as the Suffolk Building. Anyone in need of driving directions should contact the office and ask that they be faxed or emailed to their attention.

Perry indicated that the new location will provide more efficient use of office space with good meeting facilities and ample parking. The move resulting in a new office will have no impact on the delivery of services to the membership. The only thing that will change is ASHI's mailing address. The new address effective March 1st will be ASHINE, 53 Regional Drive, Suite 1, Concord, NH 03301.
